JUST IN: Chauvin Lawyer Files Motion For a New Trial, Alleging Jury Misconduct

Derek Chauvin’s lawyer, Eric Nelson, filed a motion on Tuesday for a new trial, alleging jury misconduct.

On April 20, a jury reached a verdict in the murder trial of former Minneapolis cop Dereck Chauvin in George Floyd’s death.

Chauvin was found guilty on all counts: 2nd degree murder, 3rd degree murder and 2nd degree manslaughter.

Nelson’s filing said the court failed to sequester the jurors or “admonish them to avoid all media.”

“The publicity here was so pervasive and so prejudicial before and during this trial that it amounted to a structural defect in the proceedings,” Nelson wrote.

In his motion, Nelson alleges eight total abuses of discretion by the court, including “the interests of justice; abuse of discretion that deprived the Defendant of a fair trial; prosecutorial and jury misconduct; errors of law at trial; and a verdict that is contrary to law.” – NBC News reported.

Former Minneapolis police officer Derek Chauvin filed an appeal for a new trial Tuesday after he was convicted last month of murdering George Floyd.

Chauvin’s attorney, Eric Nelson, filed the request alleging that pretrial publicity affected Chauvin’s right to a fair trial.

Nelson’s filing also accuses Minnesota state prosecutors of committing “pervasive, prejudicial prosecutorial misconduct” that also affected Chauvin’s right to receive a fair trial.

The filing also requested an order “to impeach the verdict” on “the grounds that the jury committed misconduct, felt threatened or intimidated, felt race-based pressure during the proceedings, and/or failed to adhere to instructions during deliberations.”

A juror in the Derek Chauvin trial hid that he was a Black Lives Matter activist to convince the judge that he was “impartial.”

Juror #52, now identified as Brandon Mitchell, is also encouraging people to try to get on juries to “spark some change.”

During jury selection, Mitchell claimed that he had very little knowledge of the case. However, Mitchell was photographed last August wearing a shirt that read “Get your knee off our necks” and “BLM.”

In an interview with Get Up! Mornings with Erica Campbell on April 27, the juror asserted that people need to get on juries to “spark some change,” the Post Millennial reports.

“I mean it’s important if we wanna see some change, we wanna see some things going different, we gotta into these avenues, get into these rooms to try to spark some change,” he said. “Jury duty is one of those things. Jury duty. Voting. All of those things we gotta do.”

  1. Even if I believed Chauvin were 100% guilty (which I don’t), the actions of BLM would force me to want him to go free. Forced solitary confinement because other people have been encouraged to hurt him is cruel and unusual punishment. Jury influencing. If they want him convicted they have to shut up and let the system do its job.

  2. They need yo get new jurors further away. From that area with a better chance of being impartial to the case. The trial would be much more fair than having people closer to the vicinity.

  3. This juror should be arrested tried and convicted then sent away for a long, long time. With this news and the fact that the ever crazy as hell Maxine Waters said what amounted to a threat to the jury this whole thing should be thrown out. Once again the left has to cheat to achieve its goals. God hell us if they win this war.

    1. I agree, this juror was NOT impartial. Try him and teach a lesson….not that the media will ever report this! G Floyd was a felon high on drugs…this trial is all about blacks wanting something form the blm bandwagon!

  4. Move the complete trial out of state. Get a new judge and jury! Do all of this with out any news of when, where and how! Do it with out the loud mouths getting involved and if people like mad maxxie gets involved, arrest them and put them in jail without bail or bond for90 days before the come to trial and charge them with a felony!!!! And all of this BS would end!!!!! These so called men who stated “get on a jury to make a change”, why don’t the start with the cities that they live in and start there and clean them up of gangs, drugs and the like!!!!

    1. Absolutely. The trial was not a trial looking for justice it was a circus looking to appease BLM, Mad Maxine Waters and all other radical liberals. Once additional videos from different angles were shown it was clear that the cops knee was not over the neck but on the collar bone area of the shoulder. On top of that the Medical Examiner that did the autopsy ruled that the perpetrator did not die of asphyxiation but of heart issues brought on by drug over dose. Sounds like the jury didn’t need to see or hear the facts they had made up their minds due to ongoing intimidation by BLM and others. The cop at least deserves another trial.

      1. The trial must be held in Minnesota. A place in northern Minnesota such as Roseau County would be appropriate.

  5. Considering all of the publicity this case has generated, the only way to find an impartial jury would be to search the backwoods for a community without any amenities and see if they would be willing to travel and serve. Intimidation be damned!

  6. Yes we need a new trial but we also need the nation to recover from all this madness. It will be impossible right now to have a just and fair judge and jury at any place . Let time pass and keep the case open when the time will be right.
    A new trial will be bad for the country and it is more important than to steer emotion again.

  7. Not sure where he could get an impartial jury and a fair trial, but should get a new one. The juror that lied should be charged and locked up for awhile. Maybe a cell mate for Derack.

  8. The Governor of the State of Minnesota, as well as the Mayor of Minneapolis let this problem escalate well out of proportion too the incident in my opinion. And from that moment on I felt that no truths, nor a fair trial
    would be it’s out come! They only way too correct and turn away questions would be to convict the Defendant’s
    and swiftly! NO JUSTICE SERVED!

  10. Just imagine if a White juror was found to have been at the capitol on January 6 and participated in the fury. A mistrial would be declared immediately.
